What Is a Title VII Discrimination Complaint?
Title VII of the Civil Rights Act of 1964 (42 U.S.C. § 2000e) prohibits employers with 15 or more employees from discriminating based on race, color, religion, sex, or national origin. If you have experienced workplace discrimination, you can file a federal complaint after exhausting your administrative remedies with the EEOC.
EEOC Exhaustion Requirement
Before filing a federal lawsuit, you must first file a charge with the Equal Employment Opportunity Commission (EEOC) and receive a Right to Sue letter. You have 180 days from the discriminatory act to file with the EEOC (300 days if your state has a Fair Employment Practices Agency). After receiving your Right to Sue letter, you have 90 days to file in federal court.
