Generate a state-court complaint for wrongful termination covering FEHA violations, public policy claims, whistleblower retaliation, and CFRA violations. Currently focused on California law.
What Is Wrongful Termination?
California is an at-will employment state, meaning employers can generally terminate employees for any reason. However, termination is unlawful when it violates a statute, public policy, or contractual obligation. Common grounds include discrimination (FEHA), retaliation for whistleblowing (Labor Code § 1102.5), and violations of family leave rights (CFRA).
Common Legal Bases
- FEHA discrimination (Gov. Code § 12940) — race, sex, age, disability, etc.
- Public policy violation — termination for exercising a legal right
- Whistleblower retaliation (Labor Code § 1102.5)
- CFRA retaliation — termination for taking family/medical leave
- Breach of implied contract
Filing Requirements
For FEHA claims, you must first file with the California Civil Rights Department (CRD, formerly DFEH) and obtain a Right to Sue notice. The deadline to file with CRD is 3 years from the discriminatory act. For non-FEHA claims (public policy, whistleblower), you can file directly in Superior Court.
